MINUTES
PRESENT: Steve Smith, Glenn Collins, David Hoerle, Steven LaBranche, Dennis Murley, Lorraine Giovinazzo.
ABSENT: Judith Williams.
STAFF PRESENT: Deputy Natural Resource Officer Amy Usowski.
ALSO PRESENT: David Bushley, Traute Bushley, Sandra Larsen.
Chairman Murley opened the meeting at 7:00 P.M.
Mr. Collins MOVED and Mr. Hoerle SECONDED the Motion to approve the Minutes of
9 June 2009.
SO VOTED UNANIMOUSLY.
7:15 P.M. Continuation of Hearing on Notice of Intent filed by Frank & Janet Bianco, 290 Salt Works Road, Map 04, Parcel 005A.
Deputy Usowski noted that the applicants’ representative has requested that this hearing be continued indefinitely.
Mr. Hoerle MOVED and Mr. Collins SECONDED the Motion to continue this hearing indefinitely.
SO VOTED UNANIMOUSLY.
7:20 P.M. Rock Harbor Parking Discussion.
Mr. David Bushley and Ms. Traute Bushley, 480 Dyer Prince Road, were present for a discussion regarding the Rock Harbor parking area.
The discussion centered on the fact that visitors to the beach are driving onto the dune and how the Town might be able to deter, as well as block people from driving on the dunes. Ideas suggested included the need to formalize one path to the beach, blocking off the stick dock area, and planting beach grass.
The Commissioners agreed that a site visit is in order and there needs to be a formal plan to finalize access to the beach.
7:45 P.M. Administration Review, Gibson, 80 Depot Road, Map 15, Parcel 003.
The Commission discussed Mr. Gibson’s request to remove one dead Pitch Pine tree for safety purposes.
Mr. LaBranche MOVED and Mr. Hoerle SECONDED the Motion to ratify this Administrative Review.
SO VOTED UNANIMOUSLY.
7:50 P.M. Administrative Review, Steinbauer, Nauset Haven on Minister’s Pond, 3280 State Highway, Map 11, Parcel 049.
Commission Collins recused himself form this discussion due to a possible conflict.
The Commission discussed a request to remove a Pitch Pine and a Cedar tree which is endangering one of the cottages.
Mr. Hoerle MOVED and Mr. LaBranche SECONDED the Motion to ratify this Administrative Review.
SO VOTED UNANIMOUSLY.
Commissioner Collins returned to the hearing room.
8:00 P.M. Administrative Review, Hurd, 320 Samoset Road, Map 14, Parcel 134.
The Commissioners discussed this request to remove 5 or 6 trees which are all extremely close to the house. There is one live and one dead Pine, and Olive tree and 2 Oaks.
Mr. Collins MOVED and Ms. Giovinazzo SECONDED the Motion to ratify this Administrative Review.
SO VOTED UNANIMOUSLY.
8:05 P.M. Request for Extension Permit, Gould, DEP SE 19-328, 60 Cove Road, Map 18, Parcel 050.
This request is to continue beach nourishment between the boat ramp and the dock which has been in existence since 1948. The Order was also amended to include the removal of invasive species.
Ms. Giovinazzo MOVED and Mr. Hoerle SECONDED the Motion to grant a three-year Extension for DEP SE 19-328.
SO VOTED UNANIMOUSLY.
8:10 P.M. Request for Certificate of Compliance, Maggiore, DEP SE 19-955, 115 Eldredge Drive, Map 01, Parcel 056A.
Deputy Usowski reviewed this request for the Commission. She said the project is complete and looks good. She said it was in compliance with the Order of Conditions.
Mr. LaBranche MOVED and Mr. Collins SECONDED the Motion to grant a Certificate of Compliance for DEP SE 19-955.
SO VOTED UNANIMOUSLY.
8:15 P.M. NStar Herbicide Spraying Update
Deputy Usowski informed the Commission that the Board of Selectmen have sent a letter to NStar stating their displeasure about the herbicide spraying. She stated that many citizens have called about this issue and have been directed to call NStar directly.
Deputy Usowski told the Commissioners that Ms. Williams was have second thought relative to re-appointment to the Commission after her term expires at the end of June.
There was no further business and Mr. Hoerle MOVED to adjourn at approximately
8:30 P.M. Ms. Giovinazzo SECONDED the Motion
